Estate & Trust Planning

Estate Planning

It is important for individuals and families to have an estate plan in place. The attorneys at Webber Law work with clients to inform them of their various options and outcomes when preparing a last will and testament. This guidance ensures proper distribution of property and assets to chosen heirs upon someone's death. An incorrect estate plan may result in increased estate taxes or distribution in a manner not approved by the decedent.

Additionally, the attorneys at Webber Law assist clients to prepare financial and health care powers of attorney and living wills.  These are documents that are created for use during an individual's lifetime.  They determine who can act on behalf of an individual when he or she becomes incapacitated.

Estate planning documents can be customized to meet the unique needs of every individual. Our attorneys are available to discuss how we can protect your estate. Call us to discuss the different estate planning documents and how they can benefit your estate plan.

Trust Planning

A trust is a legal document that is permitted to own assets.  A trust typically appoints a trustee who is in charge of managing the trust's assets.  Trusts can be either revocable or irrevocable.

Revocable trusts are often used to avoid probate, to plan for federal estate tax avoidance, and for ease of administration when someone owns property in multiple states.  These trusts are created during someone's lifetime and managed by the person creating the trust until they are incapacitated.

Irrevocable trusts are often used to plan for certain situations such as long-term care, a disabled child, or general asset preservation.  They trusts are more complex than revocable trusts and cannot easily be changed once created.
